Agreement to terms
1. Welcome to www.theorb.org.nz (the “Site”), a website hosted and operated by NetSafe (”we”, “our”, “NetSafe”). These terms apply to the entire contents of the Site. By viewing and using the Site, you will be deemed to agree to these terms.
Intellectual property rights
2. Copyright in material on www.theorb.org.nz
www.theorb.org.nz provides links to, and portions of content from, public sector websites (together, "material").
To the extent that there is copyright in such material, that copyright is either owned by the Crown or licensed to the Crown by the public sector bodies from whom it has been sourced.
3. Your reuse of material on www.theorb.org.nz – Creative Commons Attribution BY licence
When persons or agencies add such material to www.theorb.org.nz, they provide a licence to NetSafe to sub-license that material on the terms of the Creative Commons Attribution 3.0 New Zealand licence (see clause 4 below).
This enables us to license all copyright material on this Site under the Creative Commons Attribution 3.0 New Zealand licence. In essence, you are free to copy, distribute and adapt such material, as long as you attribute the material to NetSafe and abide by the other licence terms. 4. Your licence to us for contributions to www.theorb.org.nz
Other than personal information not visible on the Site, which is covered under the Privacy Policy, any material you transmit or post to the Site will be considered non-confidential. We do not claim to own your copyright material. You do, however, grant NetSafe a non-exclusive, royalty-free and irrevocable licence to:
- publish such material in any media and in any format, including on this or any other website, in hard copy publications, in email notifications and alerts and in web feeds; and
- sub-license such material for re-use by others pursuant to the terms of the Creative Commons Attribution 3.0 New Zealand licence.
5. Third party copyright
If your contributions to the Site include material in which copyright or other intellectual property is owned by a third party, you warrant that you have the right to use that material and to grant the licence referred to in, and on the terms of, clause 4 above.
Visitor material and conduct
6. Unacceptable use
You are prohibited from posting or transmitting to or from the Site any material that is illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable.
Please note that submitting spoof reports may result in you being charged with making a false complaint.
7. Co-operation with authorities
We will co-operate fully with any law enforcement authorities or court order requesting or directing NetSafe to disclose the identity or locate anyone posting any material in breach of clause 6 above.

While we will use our reasonable endeavours to maintain www.theorb.org.nz, NetSafe is not responsible for the currency or accuracy of content on or from such other websites. NetSafe disclaims and excludes all liability for any claim, loss, demand or damages of any kind (including for negligence) arising out of or in connection with the use of either this website or the information, content or materials included on this site or on any website to which it is linked.
The inclusion of a link to a third party sites does not imply any endorsement of the linked website or its content or provider.
Revisions
9. We may revise these Terms of use at any time. Any such revisions will take effect once notified through a notice at the end of these Terms of use detailing the respect(s) in which the Terms have changed. We may also elect to place such notice on the Site’s homepage.
